Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") govern your use of the Driving Instructor Logbook mobile application (the "App") provided by Driving Better AI Limited ("Driving Better AI", "we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. App store terms (important)

If you download the App from the Apple App Store or Google Play, your use is also subject to the applicable store terms and policies. On Apple platforms, the Apple Licensed Application End User License Agreement may apply unless we provide a custom license; these Terms supplement any applicable store terms.

3. What the App does

The App is an offline-first tool for driving instructors to record training sessions, coaching notes, mock test results, scheduling details, and simple finance records. The App is intended to support professional workflows and does not replace qualified driving instruction, official guidance, or your professional judgment.

4. Safety

Do not use the App while driving. You are responsible for using the App safely and complying with road safety and distracted driving laws.

5. Your responsibilities (including learner data)

• You are responsible for the accuracy and legality of any information you enter into the App.
• If you store personal information about learners (for example, names and lesson notes), you are responsible for complying with applicable privacy and data protection laws (including providing any required notices and obtaining any required consents).
• You are responsible for how you store, share, and protect exported backups.
• You must use the App in accordance with applicable laws and regulations.

6. Subscription (Premium), billing, and cancellation

Some features may require a paid subscription ("Premium"). Subscriptions are sold and billed by Apple and/or Google, not by us. Pricing, taxes, renewals, cancellation, and refunds are governed by the applicable store’s terms and your store account settings.

• Auto-renewal: subscriptions may automatically renew unless cancelled in your store account before the renewal date.
• Manage/cancel: you can manage or cancel subscriptions via your Apple ID / Google Play account settings.
• Refunds: refunds (if any) are handled by the store under its refund policies.

7. Backup, export/import, and iCloud (iOS)

The App may allow export/import and device migration features. Backups can contain personal information you entered. You should store backups securely and avoid sharing them with anyone who should not have access.

On iOS, an optional Premium feature may store backups in your iCloud Drive. When enabled, Apple processes and stores backup files in your iCloud account. You control whether this feature is enabled and can disable it at any time.

8. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own professional or personal purposes.

9. Prohibited use

You agree not to:

• reverse engineer, decompile, or disassemble the App except to the extent permitted by law
• use the App to infringe the rights of others
• attempt to bypass subscription checks or other access controls
• use the App to transmit malware or interfere with the App’s operation

10. Intellectual property

The App, including its software, branding, and design, is owned by us or our licensors and is protected by applicable intellectual property laws. You do not acquire any ownership rights by using the App.

11. Third-party services

The App may interact with third-party services you choose to use (for example, Apple/Google app stores for purchases and iCloud Drive for backups). Third-party services are governed by their own terms and privacy policies.

12. Disclaimers

The App is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, or error-free operation. You are responsible for verifying that your use of the App and any outputs meet your professional needs.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from or related to your use of the App, including any loss or exposure of exported backups you choose to store or share.

14. Changes

We may update the App and these Terms from time to time. When we update these Terms, we will update the "Last updated" date at the top of this page.

15. Privacy

Your use of the App is also governed by our Privacy Policy.

16. Governing law

These Terms are governed by the laws of Hong Kong, excluding its conflict of law rules. Where required by applicable law, you may have additional consumer rights in your place of residence.
